Hi folks,

The story is long. The story is obnoxious too. Weird. But totally true. And excellent news are coming. I'll try to make it as short as possible. At last, this leads to some EBMM-related news.

From 1997 to 2003, my wife and I had an Internet company (what we call a "dotcom"). During all the time, this company had excellent performance, always increasing twice its sales amount and net incomes year after year. Everything was OK, we had 15 trusty and friendly employees, and there was no trouble in our life.

Late 2002, for some reason that was never explained, the manager of our bank agency decided a woman (my wife) had nothing to do at the management of such a company, and that her part, being a woman, was sharpening her husband's socks and cleaning children's bottoms (sic). He asked her to leave the company, otherwise he would kill the company.

The fact is, he did. Using unorthodoxe and illegal methods and tricks, he led us to bankrupcy in no more than 3 months. (at this step, due to the company performance, you may figure out how many faults he committed to get that result)

So in 2003 we operated the liquidation of the company, and our personal incomes switched from € 8,000 / month to less than 1,000. We gave the Mercedes back since we were unable to pay for the credit, etc. etc. etc.

While doing the liquidation, with full agreement from the legal agent, we asked our lawyer to prosecute the bank. In Summer 2004, still nothing done from him, though the faults were obvious and official written and signed proofs were numerous.

We then decided to prosecute the bank on the penal way, and then, when convened by the judge, asked our lawyer to come on our side. He did. Though, the penal judge explained us that, besides all proofs, we were not safe from a weird decision from the attorney, who could decide not to prosecute. And if so, we would have no resort at all. He suggested we cancelled the penal prosecution and go the civil way. We took that road, and later events showed that was the right one.

Our lawyer was in charge to prepare the civil prosecution. One year later, still nothing done. We decided to get the papers back and find another lawyer. It took 5 lawyers' offices until we found the right one. At this time, we're in May 2005.

This lawyer did the prosecution immediately. Each time he was convened by the civil judge, the bank's lawyer would ask for a delay because "he would miss information". In the meanwhile, using another illegal trick, the bank and her lawyer tried to get some money from us (while we owe them nothing) and tried to have our house seized. They failed, but the purpose was clear : trying to put us completely down, so that we would become unable to prosecute.

Finally, my wife had our lawyer on the phone last Friday. He had very good news. Exasperated by the bank's lawyers's delay requests and unability to give any argument to answer the accusations, the judge decided she would now take her decision without any complementary elements, which means no defense for the bank, since they missed their chances of defense half a dozen times playing some obscurantist game.

Decision of the judge will be known in April, and things are clear now, the bank is soon KO on that round. The damage we suffered because of the bank is close to € 1,000,000. Though, I'm lucid enough not to believe I'll have that amount, neither have it on April 30. But normally 2008 will bring some sun in my sky, which means I will, AT LAST, be able to complete my EBMM collection.

(and yes, my love for bank managers is very limited, due to a relating "dotcom" story...)

What a storie! All I can say is (in his best french accent) Your bank managers Mother was a hamster, and his Father smelt of elderberries. I turn my back on him ;)

Good luck on the settlement. I hope it allows you to complete your collection, and visit us here in The States.

Yes I'll come to America, this has been planned for a looooooong time, but due to what is explained above, money issues didn't allow me to yet. I promise I'll keep you updated.

BP, can you also figure out that the guy was not only stupid enough to do all that but also leave written and signed traces of all his crappy stuff ?
And can you imagine that he was at this time the manager of an average agency, and he is now the regional director of that bank ?
All I can figure out is what will become of him when the national direction will see how many hundreds thousands euros they're gonna lose because of him, and only him.

I've been having a wiiiiiiiide smile on my face for 3 days now. The guy had told my wife "I'm gonna put you down". Now some wind is turning... ;)

BP, please prepare your fidelity cards for knuckleheads who buy numerous EBMM basses ;)

Mark, only the judge's decision will tell, but to make it simple : we gave numerous proofs of the faults, while the bank gave nothing to explain the faults.

If the bank is sentenced to pay, they'll have no other choice than pay, and pay fast. Otherwise, according to French laws, they can be led to bankrupcy pretty fast.

If the bank is not sentenced to pay, I still have some other resort.

And anyway, no matter what the judge's decision is, when the civil pursuit is finished, we'll then lead a penal one. I decided from the start these embezzlements would not stay unpunished, and that I would do anythng possible for these punishements be as severe as possible, since their acts were attacks to a fundamental (and constitutional) right : the right to form, manage and make a living out of a company. I've shown to be obstinate and won't change now ;)

There are so many examples of ordinary, innocent people becoming victims, often based on the greed and/or stupidity of others. You are thrust into a defensive positiion and sometimes have to live through Hell, often for an extended period of time (like in your case) before it is resolved, one way or the other. I hope you end up on top. Take what you get and use some of it to put it behind you ... like a few trips and new EBMM basses.

Wow, Jean, I am absolutely shocked. Hard to believe this kind of mentality comes out of a French company, them being stereotypically forward-thinking when it comes to women in business. Let's not even get Beth started on that one... :D But the good thing is that the French courts are obviously not standing for it -- good fight, Jean!

In other news, Argentina just elected their first woman president! Hope she does a great job. Chile has a woman president too. Funny to think that in stereotypically "machismo" countries they've elected women. Times they are a-changin'...

That's because while men were spending the day drinking in bars, their wives went to the voting booth. :D

Being a woman is (generally) no more a handicap in social / public / political life. Our female finalist in France, at latest elections, was not beaten because she was a woman, but because she was incompetent. I'm pretty sure that if she had been a man, her/his final score would have been even worse than what it was.

Now as you read, some bank managers still think being a woman is being incompetent. This kind of macho specimen is going rare these days though, since, due to recent facts I wrote above, it appears to be a very expensive game now.
