The guy just got back in town and was heading to work to ship my Blue Dawn when...

I'm afraid I have some bad news. This morning while traveling into the office I was involved in an accident. A gentelman ran a stop sign in his pickup truck and my car was T-Boned. The Petrucci, along with my Mesa amp, and my Les Paul were badly damaged. The case for the Petrucci was almost bent in half. My amp chassis was damaged and all the tubes taken out.
The Les Paul is a complete loss as well. I got what is left my gear out of the car and couldn't even bare to look at the Musicman case. I basically had to destroy the case to open it, and found the Petrucci in pieces. The headstock is completley snapped off, and the the neck is snapped and holding on by the truss rod, additionally the body is cracked in the lower horn area. I was lucky to walk away with only minor injures thankfully.

Oh well... Is there anything EB can do for this guy aside from charging him for a brand new guitar? Can they even spray Blue Dawn anymore? I have had some **** SORRY ****ING luck lately.

Rush,
Is this the one you bought off of eBay? Hmmmmmm. Something smells funny with that one. Did he offer you pictures of the damage? Did you get your money back?

Call me cynical, but I'm always leery of stories like that. If he's on the up and up, I feel sorry for the guy though, and you as well since you were looking forward to that one.

Yes we can spray Blue Dawn. We can also sell him a new neck and body(we need the broken parts returned to us) and we could use whatever parts that weren't destroyed in the accident to build up the new one.

He sent a full refund and I asked if he could at least provide a photo of the damage to confirm it. I hate asking for one, but I don't think it's too much
to ask. We'll see if he sends one, and if he does I'll post it here.

It sucks, but then again it's just a guitar. It really pisses me off though as I had went through with selling my Silver Sparkle to handle the costs. I could cancel the sale on the Silver since I have yet to get payment for it, but I don't want somebody else to get let down like I did so I'm gonna go ahead and sell it.

Hey, I agree. However, I was gonna trade my Pearl Redburst for a Blue Dawn Axis when the neck was snapped. I told the guy, and it was painful to tell him. He thought I backed out (which I don't blame him) until he saw the pics. I had to be honest with him and had the pics to prove I wasn't BSing him. I felt bad because we both were eager for the trade. Sometimes, life happens.

Rush, get some pics if you want. But, believe me, they are painful to look at! Since my JP is being fixed by Jon, I will never part with it. She was meant to stay home with me.....hehehehe....

Rush, sorry about your luck lately. Man, play the lottery, it can only get better from here on out.

Rush,
I hope I didn't come off sounding like a smartass.

I feel bad for you since I know how much you were looking forward to that one. Wasn't it one of the one's that JP actually signed or am I confusing that with Pete's?

Anyhow that's real good news from Jon so maybe there's hope yet.

hang in there!

Rush,

Sorry to hear about the Blue Dawn. I think it's very cool of you to continue with the sale of your Silver Sparkle, though. After all, that's a whole other transaction.
Maybe it will improve your karma.

Rush,

While making no accusations against your ebay seller, I relate this story:

About two years ago I saw a beautiful mint chromeboy on ebay. I was afraid that someone would offer the guy some dough to end the auction eary, so I contacted him and arranged an off-ebay sale myself. I sent the guy the dough thru paypal only to have it refunded the next day. The guy said that when he was packing it he dropped it into a cymbal stand that took a nice chunk out of it.
Okay, weep, weep, weep. While searching on ebay the next day I saw an ended buy-it-now auction for a satriani chrome guitar, the word ib**z or chromeboy were not mentioned in the auction, and it sold for over $700 above our agreed price. I emailed the guy telling him that he should have won the oscar for his performance. He said he was sorry, but $700 was just too much for him not to break our agreement. I told him it was okay and to tell the truth in the future, I hate liars!

Well that's my broken-guitar-sob-story-before-it-was-shipped-to-me story

I hear ya man.. it's quite possible and I've thought about the myriad of different things that could have happened. We'll see if he can provide pics or whatever. It shouldn't be too hard to tell based on his response.

This sounds strange to me. What do you guys think? I don't know of any insurance companies that have places to store destroyed merchandise do you?

Hi David I appreciate your understanding. Sorry that this adds to the bad streak. What a terrible day here. Im sick to my stomach. Anyhow my insurance company is involved and in order to be covered for my equipment losses they have taken possession of the damaged gear for evaluation of replacement costs etc. If they pay for replacement then they keep the damaged goods. A co worker took me to drop the gear off earlier this afternoon per my agents request. I let them know about the Ernie Ball and that the color is irreplacable. I will give a call to my agent to see if he will just let me have it back and forfeit a claim on just that guitar. No sure if they will or not. I should know by Monday or Tuesday.
I will let you know and again I'm very sorry. For now as promised I have started the refund process and according to Paypal should hit your account by Wednesday. Its good to know that EB can rebuild it! That's about the only good news today.

I am not 100% sure, but, I believe they obviously have to see the damage. That much makes sense. To store or take it, I am not aware of. I believe someone here is in the insurance business and hopefully will chime in. I wouldn't see any reason for them to hold on to it. That's just me.

I did notice that he said he put in for a refund. That would be my first concern, making sure the $$$ got back to you. Who knows, maybe a pic will surface and all is as he says. :(

Wow. I'm really sorry to hear this news Rush. I am especially sorry to hear that you found out this news after you already made the decision to let you're Silver Sparkle go. I'm reluctant to comment, because I am always immediately skepitcal about this type of stuff and I don't think that is going to help here. I don't think the email you sent him was unreasonable. I hope things take a turn for the better for you, Rush.

The holding of the gear sounds right to me.

Although, if you(or the insured) were to tell the insurance agent the procedure of replacing the guitar, they should be able to release it to the Music Man company and pay for any labor costs to build the new one from the old parts that are salvagable. If it is to be done, the insurance company would want to be the one in control of the replacement process so they end up paying as little as possible.

I know that when an insurance company declares an automobile 'totalled', they do take posession of the vehicle.
