No, it's not. Caveat emptor. It is no more e-Bay's responsibility to filter than it is the responsibility of a newspaper to police every classified ad submitted to it.

Besides, it's simply impossible for any marketplace like that to examine every single ad. Just exactly how would you propose that they "filter all the bad stuff" out of the millions of auctions posted every year? I cannot imagine any mechanism that would actually work.

On top of that, there's the issue of whether it's really a counterfeit or not. Just what constitutes a counterfeit? The ad clearly states that it's a copy. The headstock does not say that it's a Music Man. It's shaped just like a MM, but it doesn't claim to be one. In my book that's not a counterfeit, nor is the seller trying to mislead anyone. I'm no more fooled than I would be by a Rolex copy that said "Rodex" on the face.

It does happen to be illegal because it's got the same headstock configuration as a MM guitar, which I believe is a trademark. But other than that? The body shape isn't trademarked. Just look at all the perfectly legit Strat copies there are in the world.

We filter this stuff in exactly the same way that we're doing it right now. Through skepticism and the open exchange of information.

I just sold an SX guitar because I bought an AL. For what I paid for it, it was a fine piece of work. It was no Music Man, but it was solidly built, nicely finished, played well and most important, cost under $200. I knew exactly what I was buying...a $200 guitar. At the time, that's what I wanted.
