Final Judgment entered in Ernie Ball, Inc. v. Earvana,LLC Case No 5:06-CV-00384-JHN-OP

Ernie Ball prevailed at trial in this patent infringement case against Earvana regarding compensated nuts. Henry Welles is the attorney on the matter for Ernie Ball.


1. Earvana is permanently enjoined from using the compensated nuts protected by the patent of Ernie Ball.

2. Earvana is assessed patent infringement damages for past use of devices infringing on the Ernie Ball patent.

3. Earvana is assessed prejudgment interest.

The case was tried in the Central District of California Federal Court before the Hon. Jacqueline H. Nguyen.
Judgment was entered Jan. 5, 2011.

Congrats to both you and EBMM. Does this mean that they cannot use the term "compensated nut" or anything that is similar in design to the EBMM compensated nut?

I just looked at your website and profile . . . Bucknell . . . did you know Fred Kohler at Bucknell? I went to NT with his brother and stopped by Bucknell to pick him up one Christmas break on our drive from TX to MA.

Earvana cannot use non-sinusoidal compensated nuts. These are subject to the Ernie Ball patent. Earvana can continue to use its sinusoidal retrofit nuts, which are different.
