Final Judgment entered in Ernie Ball, Inc. v. Earvana,LLC Case No 5:06-CV-00384-JHN-OP

Ernie Ball prevailed at trial in this patent infringement case against Earvana regarding compensated nuts. Henry Welles is the attorney on the matter for Ernie Ball.


1. Earvana is permanently enjoined from using the compensated nuts protected by the patent of Ernie Ball.

2. Earvana is assessed patent infringement damages for past use of devices infringing on the Ernie Ball patent.

3. Earvana is assessed prejudgment interest.

The case was tried in the Central District of California Federal Court before the Hon. Jacqueline H. Nguyen.
Judgment was entered Jan. 5, 2011.

Does this mean the Earvana product is no longer available for sale?
Or does EBMM get a royalty for each Earvana sale in the future?

Indeed, it is always sad when litigation is needed as it truly represents the lack of decent behaviour and/or communication... But I am a bit of a romantic, so I may be completely wrong about this.

Anyway: congrats on a job well done to Henry and congrats to Poppa and the gang on the victory.
