As counsel for Ernie Ball, Inc., I am providing notice of the following:
Federal law makes it a crime [punishable by a fine or imprisonment for up to two years, or both] to engage in interstate telecommunications made anonymously with the intent to annoy, abuse, threaten, or harass any person who receives the communications. (47 USC 223(a)(1)(C)).
Included as a prohibited telecommunication is "any device or software that can be used to originate telecommunications or other types of communications that are transmitted, in whole or in part, by the Internet ." Engaging in anonymous and annoying or harassing e-mails and pm's across state lines is a Federal Crime.
Harassing communication may also be actionable under California State law (CCP 527.6.)
If anyone has recieved any annoying or harassing e-mails from anonymous individuals, please immediately forward copies to me, including the header information. Fax copies are preferred, but forwarded e-mails are acceptable.
