Headstock and Pickup Question

I was browsing thru Musicians Friend online and noticed that F****r has come out with a 5-string P bass. With the 4+1 headstock design that I thought was an EBMM design? Is this legal?
Also, I saw some replacement pickups in the EBMM style that say "licensed". Does anyone have a license to make pickups besides EBMM?

The 3+1 headstock is a Musicman trademark (or something like that), the 4+1 not so.
