are any 2nd chance offers legit thse days? best to email seller and the original buyer and get them to confirm the situation first. surely that would help.

Regular emails can be faked to look like an ebay email so dont click on anything. If its official it'll appear in your web based ebay message box, if not its a thieving tosser trying to rip you off...
