There is a debate going on at JP's forum regarding the sale of EBMM guitars and basses. Essentially what is being said is that only official EBMM dealerships are bound by the no international sales clause and that shops that simply carry a few EBMM guitars, but aren't official dealers, are not. I was under the impression that in order to sell new EBMM's, a dealer must agree to the no international sales rule... so in essence there would be no such thing as "unofficial" dealers. Could some one clarify this?

My understanding is the same as yours. I think they have to sign an agreement (which covers a lot of things) but one of them is that they can't sell new guitars outside of their country.

But (I'm not 100% certain of all the conditions, so this is my best guess from what I can remember) BP has given the rule that they can sell LE's that are over 24 months old.

CS may be able to offer more insight, although I wouldn't bother them over this myself, but if they get a chance someone may clarify it. :)

Being a dealer is like being pregnant. EIther your are pregnant or your are not. There is no inbetween. There is no such thing as an un official dealer of our instruments.

Thanks BP and everyone for the answer. I wanted to bring this up out of concern that there may be something fishy going on in some circles.

The thread in question is this:

Music Man BFR - shops - John Petrucci Forums

Page 2 is where the confusion sets in...

Could it be that some un-authorized dealers are buying the guitars from actual dealers and then re-selling them as new?

Thanks for the link.

Makenmusic will NOT sell new EBMM's outside of the US. It looks like some people are buying the guitars from a dealer, then re-selling them, hence the lack of warranty.

There is the one exception to the selling overseas thing. If there is a limited production instrument that isn't available anymore and a U.S. dealer has it as NOS. He can sell it abroad if a certain amount of time has passed (6 months?) since the instrument went out of production. Am I not correct?

For example, Joe U.S. EBMM Dealer has a NOS 2004 LE Rad Red Sterling sitting in his stock. That could be sold to a buyer abroad, right? He could sell it to a buyer abroad if it were used too.

Sometimes I just pick my battles. We all read things on forums where we just shake our heads at the stuff being put forth as facts. But there isn't enough time in the day to make sure every last person understands the ins and outs of being a dealer, int'l shipping, tarriffs, taxes, duties yaddah yaddah. :)
