I just had a chat with Amazon. They advise ....

Sorry but what´s the problem? Is it illegal?
It doesn´t say EBMM on the headstock, it has a different headstock shape and you can see on first sight that its not a EBMM.
Here on ebay germany we have A LOT of those from brands like Johnson, Career Dimavery etc.

And all of those STAGG, Johnson and other ripping off bastards do not have the license to copy MM design. AS far as I know nobody have it. There is only a Sterling by Musicman. There was an OLP i nthe past but did not EBMM closed that company?

I agree with the Bongo.

I think the issue here is that Amazon, who are an authorised EBMM dealer, are selling obvious Stingray copies from another supplier. If I were EBMM I'd be requesting Amazon desist selling the copies, or I'd pull their dealership status.

Dunno if it makes any difference but it's a 5 string with 4 + 1 headstock. I think the 3 + 1 is the one with the patent? No doubt someone will be on to it shortly.

If EBMM doesn't protect their property it will ripped off constantly and people who don't know better will buy it thinking it is the official EBMM instrument. Don't be ripping off other people's hard work. It is a blatant rip off.

You can't patent a guitar body shape. You can't copyright it either. You can however trademark it, however it has to be around for a while for EBMM to be able to trademark it. As the body shape is similar to a ton of other guitars, body shape trademarking is not going to happen. Maybe the peghead.

In the end though, as the whole Gibson vs PRS lawsuit showed, it has to be exact for it to be trademark infringement.

A couple of days ago I've seen this called "high quality MMSR copy made in China" on some local trade board. Just wanted to share my burst of indignation with you guys. <(*,...,*)>

We got one of those MMSR China made basses seized and destroyed by Customs, so they are looking out for them.

The headstock shape, and tuner configurations are registered trademarks. The general appearance, including the body shape and pickguard and knob locations is "trade dress" meaning a type of general trademark right where if someone copies the overall look it is infringing.
