Small claims court is the way to go. No need for an attorney. Cost is mostly time, not money. I can't see how going on another website will get you any $. It may work against you later as some evidence of a 'vendetta', smear campaign, or attempt at a shakedown. Keep it kosher.

That's 4 cents now.

I just visisted the web site... the certified pre owned pages are on their domain (that means it's legally part of their business, at least in Europe) and they claim that these basses got sold with a certificate of authenticity.
IMO, they're involved, whether they received any money from Mr. web-guy or not does not matter.

I don't know what I'd do if I were you cause I don't know enough about American law and what is precedent in cases like this but if you feel you have a chance then go for it.
If I was in charge I would pay you the difference and fire the web guy, or at least tell him stuff like this should never happen again.

My 2 cents.
Send a link of this thread to the company involved - 5 pages (so far) isn't doing his reputation any good with fellow players (perspective buyers).
I run my own business and this kind of publicity wouldn't be worth the cost of fixing a "perceived" wrong.
I have "subbys" (sub-contractors) working for me through out Australia and as they are representing me and my company, I wear the problem if they stuff up.
I don't know why you won't name the company though as what is to say that someone here may not fall into the same issue with a consignment sale through these guys.

Sorry, Sterling, but I have something to add. Delete if you like. I think there have been a lot of decent ideas expressed, but can we take a moment to focus on one aspect of this situation?

It has come up in this thread already, but I think there's an important lesson here for any of us who are, have been, or may be business owners, or are advisors to business owners. The owners of this business should NEVER have set up this web site in its current form. If they couldn't manage this subset of their business (which is how it is perceived), they shouldn't have linked their name to it. And they are making the situation worse by not stepping up. I'm not saying this as a rip to them, I'm saying it as a warning.

In my experience, the few thousand bucks we're talking about is a cheap lesson for a mistake of this caliber. Their disregard for the possible damage to their reputation is disturbing. Not because it means their product is lessened by it, but because they are demonstrating a profound lack of understanding of responsiblity and customer service. This sort of thing always distresses me.

I don't think this necessarily makes them bad people, just blind about various areas where this situation applies to their business. It could even be that they are in the process of taking action on the situation but don't want to involve others in their internal dealings. In any case, it shows that (a) you shouldn't put something in your name that you can't properly manage and (b) when dealing with frustrating situations where you feel you have no responsibility, you might want to step back and try to think of how it would appear to the average outsider.

To me, this is a valuable lesson and viewing it from various perspectives may give us useful applications to our own lives.
