It's really cheesy from them not to ask you for permission.
On the other side you have to expect something like this when you make your videos available for eyveryone on youtube.

huuuuuuuuuuum :(

on the other hand Tristan, this is the problem with Youtube and I think that most of the people think that once the video is posted it can be "used" without any permission.

I understand your frustation here but this store is probably assuming as you are a Music Man endosee it's "normal" to use such material for sale

They are completly forgeting the artist sensibility here and that's the bad point !

Actually Tristan I dont think that when you post something on You TUbe that you shold get upset if it gets rebroadcast. You should have a watermark on it that has your name and website. Further isnt the reason why you are an endorsee is to help sell and promote our giutars?

It's not like they're stealing your music.
Both you and the guitar are being promoted.

And i bet you don't get any money from Youtube.com either?. I can see why you are mad about this situation, but i don't think money was the reason you made those videos...

You just happened to go to this web site and found the video? Do you frequent this place? Just see if they would mention you or see if you can watermark the video. If not use the watermark in future videos. Don't get all bent out of shape. This is the second time someone snatched your vid right?

ya one of the main reasons youtube has spread like mad is the fact that their videos are embdedable on any web page.

im sure you agree to something that allows this to happen when you sign up for youtube

http://www.youtube.com/t/terms said:
You also hereby grant each user of the YouTube Website a non-exclusive license to access your User Submissions through the Website, and to use, reproduce, distribute, display and perform such User Submissions as permitted through the functionality of the Website and under these Terms of Service

im not a lawyer - but ya sounds like this is cool esp. since they're not directly making money off your video. IF they charged people to watch that video you'd have cause per section 5 on YouTube - Broadcast Yourself. ... but technically theyre not making $ off the video so theyre clear.

anyone concerned about any thing like this on any site should read that site's particular Terms of Service.

also ditto what BP said :)

I agree with both of you 100%. But Tristan should still get some sort of acknowledgement of who he is.

I believe youtube is going to be a very different beast with in the next few months. They've set a date for either September or November(can't remember which), to crack down big time on copyrighted material. So all those great live concert videos and regular music videos will probably be gone.

sure - watching a $40 DVD free online does screw all the people involved in that production out of their cut... the band, producer etc - it makes complete sense to get that stuff off the site (unless some ad rev share thing happens with the copyright owners).

videos that arent for sale - well, there's no stealing involved. dont expect someone to credit you - credit yourself with watermarks throughout the video and a spoken intro saying who you are and where [online] people can learn more about you & your work
