When you own intellectual property rights, and something like this pops up and you become aware of it, and fail to take action, you may weaken your position when trying to prosecute subsequent offenders. It's probably a very miniscule risk, but you have to cover your butt.

That is right. When you own a trademark you are under an ongoing duty to defend it if you want the trademark to remain viable. You don't have to go after all the offenders at once, as long as you are adressing infringements one at a time. So while this one infringement seems small, it is important in the larger scheme. The headstock shape trademark is very important to protect. It is licensed to OLP for one thing, and if we allow infringement it devalues the tradem&rk and dilutes it.

I should have been more clear on my opinion. There is no need to act like assholes and that is exactly what is happening. Way to show just how devoted you guys are, I'm impressed and I'm sure the guy who had the guitar on ebay is too. More than likely all that guy is going to do is dislike EBMM now due stupid situation.

Well, I will not comment on your statement other than to say....you have no idea who I am or what I am about. The use of the language in your description needs to be modded, this is a family oriented forum. This is not some place where you can let cursing fly like at other forums. So refrain from it. It will not be tolerated here.

Again, YOU would want to protect YOUR product if it was infringed upon. So get off your high horse bud. Again, you don't know me enough to call me that or say I act like that. That right was given to my wife. She is the one who can tell if I am that way. In which case, from time to time, I can be one.

Now, if you have a problem with that.....PM me or e-mail me.

Dude chill, If the guy wants to sell the guitar that's fine, just don't post pictures of someone else's guitar to do it. No big deal. I guess the best thing about this forum is the guitars and the people that help make em communicate with us and answer our questions. As for the people that left (I can only think of one recently) he'll be back, he loves the guitars too much. We are a family in a way and families disagree from time to time and also defend each other as well. :)

So, I responded with my answer to that. Now, you blame us for two people leaving. I don't make anyone do anything. Simply, one person left due to a thread being deleted. I did not even see the thread and really hoped he would not leave. I have talked to him through e-mails and really like the dude. I don't know of the second person you are talking about. So, I cannot comment on that.

I am not trying to bash on you, but, you seem tense about this so, I will let it be for now. You may not like how business is done, but, that is how it is done. It protects the owner, company and ultimately, us. I'm not saying you have to like it, that is your deal, just that is the way it is.

More than likely the guy will simply post his auction again, minus the EB/MM references, and maybe a legitimate picture. Good for potential buyers, IMO.

It's just too bad that there are so many misinformed/uninformed buyers out there. Before I spend $XXXX on a bass, I try to research the background a bit...just to make sure I'm not buying a POS or fake (or paying too much money).

And, there are a lot of people out there that will blatantly use a high-ticket name to promote a copy...you see this often from OLP sellers, as well as P-Bass sellers and whatnot.

Doing your homework is key here.

I think Luke just got back from Europe, from what I remember of his posting a while back.

Probably on some much-needed R&R (the other kind).

After reading all of this I fully expect you all to keep an eye on all Fender, Gibson, and PRS copies. Since you are all so worried about the law I hope that you wouldn't overlook these other companies and their legal rights.

Seriously, let it go. I would rather play my guitar than get angry over something on a forum. Why get angry at people you don't even know? Life's too short.
