I would also try calling them. (866) 823-2255. Maybe there is an unknown issue with your email not getting to them. They have always been very good to deal with.
Just seeing this thread now. Having bought this used on eBay I can only ask if there is some sort of buyer protection available? Paypal? I would be asking for a refund.
My thought are similar to what Golem said. String alignment is OK over the pickups, OK at the last fret, OK at the 1st fret, and seems to be at it's worst between frets 7 and 9. It does suggest this piece of wood has gone awry.
EBMM will replace the neck for you with an identical neck (you can't ask for a rosewood board for example) but without a warranty you may have to ship the old one back, pay for the new neck, and pay all the shipping costs.
I must admit that when I sent previous email to EBMM customers' service something went probably wrong, since when I wrote them again today I received answer in less than three hours.
Now we are working on the matter, I'll keep you updated if you wish.
