But proving it's a scam to eBay is very, very difficult (and sometimes impossible).

Three words: KNOW YOUR DOCUMENTATION.

thanks for all the help!!!! really nice group here!!!!

Brent, you're gonna love me. :) I would like you to submit this to eBay as proof and backing on your claim:

http://www.ernieball.com/forums/showthread.php?t=4835

which shows that on 10/28, you purchased this EVH in question, complete with serial number in hand (have eBay call the "seller" on it and ask him for the serial #), and his signup date for the forum is also 10/28.

Also:

http://www.ernieball.com/forums/showthread.php?t=5029

which shows that on Nov 10th you got it back from the guy who did the clear coat, and 10/11 you posted it to your AOL hometown page.

Also also:

http://www.ernieball.com/forums/showthread.php?t=5177

which shows Dino and I talking about you selling your EVH on 11/22, and what the hell was wrong with you. :D

Also also also: (anyone feeling like we're in Monty Pythin credits yet? LOL!)

Submit the listing number AND the link to your legitimate auction, which would show it tied to you, your auction start date, end date, ending results, and so on.

You could also submit the thread of discovery, dated/started yesterday:

http://www.ernieball.com/forums/showthread.php?t=5229

*stands up and bows* Colonel Bunkmeister in the Computer Lab, using Windows 2000, Service Pack 4.

Thank you very much, game over. :D

You'd figure that dated material such as threads of these aspects should be enough to build a strong case. I think that it'd be hard for you to hack into the boards and muck with the dates, unless you're a carpenter by day, UBB hacker by night.

That, and I would personally kick your a**. :D

Now, who says that I don't bust my a** for you guys? :)

Go get 'em tiger, and keep us in the loop, huh? :)

I have this guy all the way down to $800 for an autographed EVH. I just keep messing with him, so far it's been a good time.

Hey, here's a genius idea...why not point the eBay people to this thread!?!?!?!

Or would that be too logical for them to solve the problem? :D

When things like this comes up on Ebay it usually takes 2 to 3 days for them to get rid of the fake auction. I hope the Thanksgiving weekend doesn't make it longer.

you guys are not gonna belive this.................this is a letter i got from ebay today:

Hello,

Thank you for contacting us with your concerns surrounding #5538521259.
My name is Diedrick, and it's my pleasure to be of assistance to you.

To begin, thank you for your patience in this matter. I can certainly
understand how a situation such as this can be frustrating, and your
calmness and cordialness are much appreciated.

Our policy is such that eBay does not allow sellers to use images or
text from other members' listings without their permission. If you would
like to review our guidelines concerning this issue, please visit:

http://pages.ebay.com/help/community/png-text-and-images.html

That said, I have reviewed the information that you provided, but at
this point find that I do not have enough evidence to show that the
member has violated any eBay rules.

Unfortunately, we will only be able to take action if the owner of the
image or text writes to us. In some instances, certain members will
allow others to use their images. It is also possible that they acquired
the image from a mutual source. Therefore, we often cannot remove
listings based on the representations of third parties whose credentials
we cannot verify.

We do understand the potential for further issues in this type of
situation. That is why, if you feel strongly about this issue, we
recommend you contact the seller(s) to advise them of the information
and recommend they contact us directly. Once we hear from them, we will
take appropriate action.

We want to help you, but in order to do so we need the following
information:

* The item number of a listing that you posted on eBay demonstrating
the seller copied your image(s) or description(s)

If your original email to us did not include the above information,
please send us the requested information by replying to this message.

Thank you for being part of the eBay community, and have a great day!

Kind regards,

Diedrick

this is what i sent back to ebay......

you have got to be kidding me!!!!!!! this guy is telling people that he will end the auction early for $1100.00 when the bidding is up to $14000.000!!!! the auction says he lives in texas....but he wants CASH ONLY sent to the UK!!!!!! this guy is a CROOK!!!!!! and it is hurting my LEGAL AUCTION!!!!! he is gonna take the $$$$ and run!!!!!!

It is sooo obvious that he is using images from my auction!!!!!! (the auction that i boughtr it from) if something is not dome about this crook....i will never use ebay again!!! an i will tell everybody i know how i was treated and the ebay allows cheats to roam the internet via ebay and ruin honest people like me!!!

i'm very dissapointed!!!!!!

i have 100% feedback for a reason!!!!! and people like this guy need to be shown a lesson!!!!!!

But I'm afraid that eBay won't stop this auction.
Spotting scams is the eBay communities job.
But proving it's a scam to eBay is very, very difficult (and sometimes impossible).

eBay wouldn't know an EBMM_EVH from a Les Paul.
It might take a court order to stop this scam...

Good luck Brent

If you had hinted at shill bidding, they may have investigated the user ID closer. They might have found it to be fraudulant.
