Bass seems ok.... as far as I can tell... however, last case clasp was smashed in and i couldn't even get the case open at first. The styrofoam must have done it's job.... it's smashed and soft inside at that spot and the metal frame is bent...

NOT HAPPY!

ANYWAY... THE BASS IS DIVINE!!!!!! HOPE IT DID'NT GET HURT IN IN WHATEVER DROP UPS PUT IT THROUGH.

How do i deal with the case issue?

Id contact the vendor then, theyre the first point of contact. They should give you a replacement. Id be thoroughly checking the bass over too.

I will definitely be doing that. I'm actually not sure what to check other than the finish I haven't had the pick guard off to check if electronics were jostle but everything does work perfectly. Finish looks good I can see where it dug into the star foam in the case which protected it

I LOVE THIS BASS

As Steevo pointed out, definitely start with the vendor. I would ask they send you a return label so the case and (more importantly) the bass can be examined by EBMM. My Big Al got dropped during shipping and between Bass Central and EBMM, I ended up with a new case and EBMM replaced one of the pickups.

Check the neck joint, the headstock/nut area and look down the neck for any damage.
Having had a case fall apart on me, and no disrespect to ebmm, the cases are basically formed plastic with polystyrene and some fake fur, so they arent all that supportive of an instrument.
If i had a new guitar turn up like that it would be sent straight back.

The general design of the case, Formed plastic, polystyrene, are a pretty universal formula. There designed to fall apart under heavy impact, the plastic is pretty tough to start with so it will take a good impact before it splits, the polystyrene absorbs the energy of the impact keeping it away from the instrument in the case.
Its just an occupational hazard that if your a regular gigging musician, unless you want to lug a full flight case around buying a new ABS, Hiscox style case every few years is just part of the deal, (I uses extra bits of foam padding in mine just to pad it out so its tight in its fitting but not that tight that impact energy will keep going and transfer to the bass)
I have never had an issue, there pretty tough, current case is 6yrs going strong (ill end up breaking it now saying that :p )
But in this case, its bad luck, item damaged in transit on way to customer :(
