I don't think it would have left the factory with a low nut.
You could raise it with a shim, but I'd email Customer Service first, they may be able to send you out a new nut to replace it.

i actually think its raised frets ! the strings sit good in the nut just when they hit the frets they fret out ? its doing my head in hahaha!

If they're hitting the first fret when you hold down the 4th, then the nut is too low, and that's why you're getting buzz on the open strings.
Could you get a pic of the strings/nut while you're holding down at the 4th? I'm 99% sure its because the nut is too low.

Before you drive yourself crazy take it to the guy Colin suggested with your BFR Luke and tell him to set it up exactly the way your BFR is. I think you are digging yourself into a bigger rut as something must be off that a tech with more experience (well thats what their for lol) may figure out simply and then you should then be able to get a good idea of what is up. Kind of strange when you said the issue was playability based, as Ebony boards are usually a dream to play on and probably the fastest boards out of them all. I just think that there is a minor issue that has you stumped and that you need a fresh set up and in my opinion would totally rule out a fret dress as you would have had to log some heavy playing time to put some grooves and notches in them to throw off the intonation and cause serious buzzing plus having notes fret out unless something was wrong from day one with the frets which I doubt. But just have the best guy you can find look at it as I feel it will find a place in the rotation after all is said and done. I have been their and mentally it can play with you.

In Melbourne it's 13C with 100% Humidity Outside. You think the Frets are sprouting?
