VOlume pedal Will not stay in heel down position

I have a problem with the Ernie Ball stereo pan pedal...It will not stay all the way in the heel down position. It is like the spring pulls it up ever so slightly when you take your foot off. Tried a new string kit and followed the instructions carefully. Anyone else encounter this problem before?
