Supreme Court Ends Gibson Lawsuit Against PRS



(STEVENSVILLE, MD) June 5, 2006 — Paul Reed Smith Guitars is very pleased to announce that the United States Supreme Court today denied Gibson Guitar's final appeal of a Court of Appeals decision upholding PRS' right to make a single cutaway-style guitar. When first introduced more than six years ago at the NAMM show, the PRS Singlecut® quickly captured the attention of artists and critics, winning awards for its design and quality. Seeking to stop competition to its Les Paul brand single cutaway-style guitar, Gibson moved aggressively, filing a suit in Nashville that asserted trademark infringement. After several years of expensive and drawn-out litigation, the local federal district court judge initially sided with Gibson. That court ordered PRS to stop sales of its Singlecut®. Several companies joined PRS in urging the appellate court--the United States Court of Appeals for the Sixth Circuit--to reverse the decision. Last year, the Sixth Circuit ruled that an injunction should never have been issued by the lower court. The court observed that Gibson conceded that only "an idiot" would ever confuse a PRS Singlecut® and a Gibson Les Paul. Based on that concession and the overwhelming evidence, the Sixth Circuit found that Gibson's trademark case had no merit and summarily dismissed the suit. The Supreme Court's decision today leaves the Sixth Circuit opinion in place and ends Gibson's multi-year effort to thwart legitimate competition under the guise of intellectual property law.

I was following that case because my Business Law professor and I discussed it and researched it pretty thoroughly last semester. It was really interesting to see how the prices for the PRS SINGLECUTS skyrocketted on Ebay when they were forced the stop production.

I admire that you support your fellow guitar makers and the fact that you understand that businesses can coexist, support each other and succeed instead of trying to crush each other. Very progressive business thinking BP.

I'm still hoping for the maple topped Petrucci, but since you don't make a production 12 string . . .;)

It's good news for PRS and great news for the industry as a whole - now that a precendent has been established, I presume this means that guitars from competing manufacturers can be similar to an existing model so long as they're not slavish or blatant copies. I mean, it's not like PRS ever wanted to misrepresent the Singlecut as a Les Paul ("Les Paul killer", maybe, but not a Les Paul per sé)... Anyway, I wish Fender would go after someone big enough to fight back - the way FMIC have been beating up on the boutique bolt-on guys is enough to make you sick... None of them have the financial clout to hire the legal wherewithall to stand up to the big "F", of course, so they're basically bullied into complying with Fender's wishes, however unreasonable they may be...

I always knew that Gibson made great huge planks of wood with strings attached. But I never thought they could be classified as 'basses". And now you tell me they make guitars as well? Say it ain't so! What is this world coming to?

As an owner of both PRS and EBMM I can say I am very happy that this case is over (finally). Although the SC isn't my cup of tea, it sure is an amazing guitar that smokes an LP hands down.

One thing that EBMM and PRS have in common is their dedication to super high quality production consistency across the board. These are the best two guitar companies at reaching that goal, bar none. For exampl, when I pick up an EBMM or a PRS in a store, I don't have to worry about cutting the side of my hand on the frets sticking out....:mad:

I keep telling you guys that most of the manufacturers are respectful and very friendly. We kind of share a compeetitive comraderie. For you sparkle nuts...The year I showed the sparkles at NAMM Paul Smith came in and said they were the best he had seen even better than the few he made. His words were "I hope you do better with them than I did, Sparkles dont sell"

Is Gibson gonna pay all of PRS's legal fees on this one?
Can't imagine that was a cheap one to fight.

What I wouldn't do to see a group SUPREME COURT photo, all playing PRS's!
How cool would that be to see.

Maybe Ruth Bader on the Bongo. :p
