Ok kids

THere is a guitar pick made by a small company called F-1. He called me said I was a schmuck and was ripping him off nad confusing the public and wanted money.

I had Wonderdog call him and he wanted us to liscense the F-1 through him. HE WANTED A HUNDRED DOLLARS! We then did a search and there are three applications for the F-1 name for guitars. We decided to just drop the F-1 designation

Now the funny part was the guy with the picks is a guy that I have known 30 years His name is Allen Chance but used to go by the name of Slim Chance but he has grown up from his hippie days. He is the original inventor of the DUnlop Strap lock that I use to distribute befored Dunlop bought it from him

I called SLim and said " You actually called me a schmuck over an hundred bucks.....He started laughing and saind he didnt know what got into him. I told him good luck with the pick and we would drop the name.

Well being that F1 is actually the rights of Formula One racing, I would say that anyone using it is ripping off the autosport wanting their product to be perceived as the "pinnacle" (oops golfing!) or the "Fastest" and "best".
It's funny someone trying to complain when they are in fact doing the same.

I'm sure the F in F1 is not symbolic of the words "freaky" or "fella"! :cool:

I kinda thought that F1 was what John described them as, not really as a model name. No problem!

I hope you are a better architect than trademark attorney. Formula One only owns the rights to what it uses and applies for. You cannot blanketly trademark something across all industries.....Slinky toys slinky strings as an example

And save this to your pdf I named it the F-1

Thanks BP once again for keeping the info coming:D Oh by the way I like how you refer to us as kids. With all this talk of toys around here you can help but to feel like a kid, if only I had some rich parents that could buy me one of everything!

Yep, and Slinky clothing too. Seen it on QVC. Horrible...

ha,ha,ha,ha....I've come across the Slinky clothing line on QVC B4.


You can call a Ferarri a Ford Pinto if u want...but it still goes 200mph regardless!!!

I have some of those F1 picks... no comment.

Maybe you could name it something else similar, like you did the Axis SS, or some other muscle car package like GTX or Mach1. Something along those lines?

I tried to post earlier, but it didnt go through. Sterling, I did NOT call you a schmuck, lets get that straight. As far as the Hundred bucks goes, i even offered you a license for a dollar. The money isnt the point, its letting the trademark to be used on a product that falls into the same international trademark class, which happens to be 015 for guitars and picks, without a license. We started using F-1 and X-1 in 1998 as trademarks for our ergonomic picks and pick grips. I became aware of a company in the UK called maverick guitars , that started using F-1 and X-1 as models for their guitars, coincidence? recently i did a google search and came up with Gary kramer usin F-1 for his ergonomic 7 string guitar , ergonomic pick, ergonomic guitar, the products are not the same, but trademark law is based on the fundamentals , of "looks alike , sounds alike , is likely to cause confusion in the mind of the public as to the SOURCE of the goods". Im sure you can understand how you would take it if i were to try to make a MUSIC MAN pick, your boot would be so far up my ass id be tasting shoe polish. As you know , when you called me, i never said that you were ripping me off, i only thought that it was an oversight on your part. Sure i may have been a little hot under the collar, but when you have 3 companies jumping on your trademark at once, it sucks. We do go back 30 years, so lets keep this straight, i dont want your forum guys to think that i would call you a schmuck.

I have the voice mail message if you want to be completely straight I can post that verbatum...I think that hypothetically using the word schmuck will make you look better. You did not ever offer it to me for one dollar. If you did you ranted over 1 dollar. (still are ranting)

Our attorney reads this forum and will back me up on the 100 bucks.

I completely understand you wanting to protect your trademark and told you so.

I also could give a rats ass about calling our guitar F-1 as it sure looks generic now.

Im sure you know that a 100 dollar license fee is nothing and i may not have said it to you, but i did offer the 1 dollar license to kramer, they arent using it anymore either and It isnt generic. it just seemed like a joke to be "negotiating" over 99 bucks. Now you have my curiosity up. what did i call you?? after 30 years , and all, i did apologize, and as i recall you did too.
