Being a german dealer (guitars of course) myself I feel very ashamed that such a thing happens but aholes are in every country.
Little story from munich, bavaria:

In the 80ies there was a very well known shop, who was one of the first to import PRS and Mesa stuff and have a load of them in full stock. AAA service.
Mid 90ies the original owner sold it to a complete jerk and the whole thing went downwards after a while and the guy is now in jail

Oh the story: Customer (now one of my customers) brought his Ovation/Adamas in his shop for a minor repair and since it had factory guarantee left he told him that the shop will send it to the german distributor. So far so good, my customer left and was happy. After asking the dealer over the next 3 month where his guitar is , he always got the same answer: It´s still at the distributor.

That was about time for the customer to call the distributor himself and guess what: They never heard of the guitar!

What happened: My customer left the shop and the very next day somebody walks into the store and asks if they have a Ovation /Adamas in stock and the dealer said: Yeah I got one in yesterday (well not a lie so far) and sold it to him.....

He did this a few times and then lawsuits came in dozens and they sent him to jail and I know there are people waiting outside for him. He sold their babies.......

Amen, had to share this.

Jerry has finally contacted us. He has talked to other forumites, had other forumites talk to Jack, he has talked to Jack and he has talked to other dealers. Jerry has finally contacted us directly and its May 10! Now Jerry wants our help.

Jerry in your email to me that shows your payment in full you alledge that Blew Hard Barr is now not communicating with you. You are looking for advice from the factory.
You also think that I want to talk to you. Your constant poking of me in here makes it so I never want to talk to you. This week you blew it. Twice. The advice from the factory is that you should see if a crime has been committed and if so press charges.
If you can find a dealer that gets lucky enough to get the guitar first when I release it this morning then you make your deal with him and file a claim with your original dealer.

Blew Hard Barr (blew daddy's line of credit) makes it sound heroic that he paid for some of these in advance. Fourteen had sat for a month and we held them instead of selling them. THere was no communication (imagine that) and no attempt to pay or keep even one good faith promise. WE were going to release the instruments unless he came up with the money. If he had already collected deposits and final payments on most of them where was the money? Once again our fault?

I wonder if he peed in a cup if it would melt?

Excellent Scott!! I didn't think I'd wind up getting that Albert Lee. Do you have a list of what's ready please so I can confirm that we are now concluded and that you have all the proper shipping addresses? I also have balances due in from Rex Bartholomew and would not want those to be drop shipped like Chuck's was untill In have collected.

Both Jerry Nighan (Albert Lee) and Scriptwriter owe me balances but I'll invoice now and contact Aziah directy when its a go to charge my card for those two.

How dare us not inform Steve.....Jerry paid his balance on 4/27 What happened to that money? If he didnt think that he was getting the Albert Lee then why was he still sitting on Jerry's deposit?

When Blew Hard Barr finally stops blaming us I will stop rubbing his nose in his lies (I cant imagine that there is much of a nose left.)

The Dude ranted on the Dudpit (that's right I said "DUD PIT") that time that we, The Evil Ernie Ball People Who Want To Put People Out Of Business, forced him to prepay his Dargies in advance, which he finally begrudgingly did. The money tree must have been fruitful that day. But what was best was that he painted himself as a hero (egads, I just thought of the Dude in a superhero outfit :eek: -- what would be emblazoned on his chest? A razor and a straw?) while calling our proforma invoice and demand to pay "borderline illegal". Our *lawyer* helped us with that one. Allow me to quote from the Dealer Agreement that the Dude signed back in '05 from the "Purchases by Dealer" section:

"Products will be purchased by Dealer at dealer prices and terms specified on EB's Dealer Price List in effect on the date EB accepts the order. EB reserves the right to change Product prices and terms, specifications and warranties, at any time with or without notice to the Dealer."

So, if we want to make him prepay for the whole shipment, we can. At least we're not like some companies out there who require 100% payment in full before they even begin building the product (which isn't a bad idea....)

Reading over the Dealer Agreement, I've digested some other phrases that show a complete breach of contract on the Dude's behalf. Things like:

"Dealer will not sell, market or distribute the Products outside of the U.S.A" hmmmm....

and

"Dealer will conduct business in a manner that always reflects favorably on EB and the Products" well, we know that hasn't happened from all the mud pies that have been slung at us since this whole debacle happened

and, in the Compliance with Laws section:

"Dealer will not participate in any illegal or unethical business or advertising practice." um, yeeaaah

Huh...The thread that Darrin started at the Pit where Dude was laying the blame at the feet of EB has disappeared. I'm shocked.

Yeah, I was thanked for posting the info. He said he didn't get any notice from EBMM......

I went to log in this afternoon and was rejected. And my user name is removed from the member list there.

Darn, it looks like I don't get to be a member of the Dudepit Titanic all the way to it's end.
